General Terms

▸All payments are made through PayPal invoicing, Invoices are sent after sketches have been approved *

▸Payment plans are available after negotiations and confirmation from the artist.

▸The artist has all rights to decline commissions or delay accepting them.

▸Donations are not considered a method of payment. (this is considered bribery)
↳ If client tries to pay via donations to get there designs pushed through quickly, this goes against T.O.S and the artist has the right to cancel the commission without refund.
▸ Payment must be sent once the sketches are approved by the client *
↳ (The client will be charge 50% - 100% from the base price if the client request to change anything after payments/ approvals have been made)*
▸By commissioning the artist, the client acknowledges that all work & designs are digital. There are no physical items.
▸Removing the artist signature from the initial artwork goes against T.O.S and will be considered copyright infringement!
▸If the artist haven't started any artwork/designs, the client can ask to change, update references, or cancel commission.
▸Commissions with a Deadline & Rushed Commission will be charged Extra (+60% to +100%)
▸ All commissions are usually streamed unless they are NSFW, If the client does not wish for any work to be streamed please let the artist know beforehand.
▸the Artist does post teasers and all finished products on social media, please let the artist know before hand if there are projects that cannot be posted until an upcoming due date!

Commercial Rights & Personal Use
▸By default, the Artist retains all rights to the designs and allows the client to obtain ownership of the work under the Personal Use License.
▸ Commercial Rights must be discussed before Artist begin the initial artwork/design(s).
↳ This does not apply to any past commissions prior to__ August 2022__
▸The client does NOT have the right to resell, redistribute, modify any of the artworks or designs under any circumstances.
▸ ALL COMMISSIONS are for personal use ONLY . twitch/discord (non-commercial)
↳ This does not apply to those that have purchased Commercial Rights
▸For full commercial use, client must pay an 80% additional fee of all Commissions/Artwork that the client wishes to hold commercial rights to.
▸The client must credit, the artist by username(Imagine Red) or Twitter handle(@Imagin3_R3D) in relevant places when the initial artwork/designs are shared or displaced publicly.
▸ Failure to uphold T.O.S and/or selling without purchasing the Commercial Rights will result in losing rights to the Artwork/Designs!
▸I have all rights to resell any Artwork/Designs that are products of Terms of Service violations.The following is considered Copyright infringement
▸ Reproducing/ using the copyrighted work or editing work commercially outside of our agreed permissions.
▸ Taking credit of the creation of the artwork.
▸ Copying, Tracing, or reposting without proper credit
Credit is still required for usage of the artwork, even if altered or edited

Cancel/ Refund Policy
▸The client is eligible for a full refund if chosen to cancel before the delivery of a first draft/design review.
↳ (does not applies if asked to pay upfront or In the case that the artist must cancel the commission, client will be given a full refund.)
▸60% refund of the down payment could be given after the first review in case commissioner didn't like it or didn't wish to proceed with the commission.
▸ Refunds will not be available after accepting first progress report!
▸DO NOT COMMISSION IF YOU ARE HAVING FINANCIAL DIFFICULTIES!
▸If money has not been sent (unless discussed), the client retains the rights to cancel the commission and will be removed from the waitlist after 30 days.
▸If the client files a chargeback against the artist, the client relinquishes all rights to all current and past works that was ever commissioned. The artist then has the right to use all and any work how they wish, whether it is sharing it or even selling it for public use.

Work Process
▸ Work-in-Progress (w.i.p) screenshots and other updates will be given by default
↳ Client is allowed to ask for w.i.p updates at any given time while the artist is working on said commission.
▸Please provide as much reference photo's and detail under the same folder when commissioning me.
▸I will only continue working on commissions once the initial sketch has been approved and as been paid.
▸Depending on your commission it can take up to 1-2 months.
▸ You will be receive updates once a week, when working on a major part, re-doing/ making changes, or when I continue to work on commission.
↳ In case of delays, emergencies, or unexpected errors you will be notified!
▸Depending on the work and complexity you will be notified on how long it will take.

▸Commissioners get unlimited changes during the sketch phase.
▸All finished commissions will be sent via email as an attachment .zip folder.
▸All changes after the initial sketch has been approved will be charged 50% - 100% based off of how large the change will be.
▸After the commission is done, commissioner will have the opportunity to request a minor change. Ex. Small coloring, line art mistakes, cleaning up small details
▸Bigger changes will have extra costs. The cost depends on the complexity. Ex. Outfit addition, background change, have the artwork/design redone completely, facial expression, etc.
▸After delivery, commissioner is still able to contact me if any issues that: have occurred, for resizing, and recoloring as well.
